Weeks after a man holding a pair of scissors was arrested on Miley's Cyrus property, Miley is taking action against the intruder who is currently serving time in jail.

According to TMZ, the "Can't Be Tamed" singer obtained a restraining order against 40-year-old Jason Luis Rivera, who was arrested for trespassing and resisting arrest when he was caught on Miley's lawn in September. Rivera was sentenced to a year and a half in prison, but Miley wants a permanent restraining order in case he gets released before that.

With the new order, Rivera must stay at least 1,000 yards away from Miley. TMZ reports that a hearing is scheduled for later this month to decide if the temporary order will be permanent.
